When a motorist has been arrested for drunk driving in Colorado the state actually files two cases. The first is a criminal DWI charge that is addressed by the court system. The second is a civil case where the Department of Motor Vehicles will suspend your driving privileges.

If the police establish that you have a blood alcohol content of .08% or higher, they will arrest you with DWI and immediately confiscate your driver’s license. With a DWAI charge, the DMV will suspend your license only if they determine that you have reached 12 driving penalty points within a 12 month period.
