Penalties for Georgia DWI

In Georgia there are two levels of drinking and driving offenses. The more serious is a ‘per se’ offense where a motorist has a blood alcohol content of .08% or higher. A first time DWI offense could lead to community service, fines and surcharges, jail, probation and loss of driver’s license. Being found guilty of drunk driving would result in a criminal record.

The second offense is charged if your BAC is below .08% though you are still considered impaired or a ‘Less Safe’ driver. There are relatively strong penalties for this crime and it too should be resolved with legal consul.

Keep your driver’s license

The Department of Motor Vehicles gives you 10 business days to request a hearing and seek continuance of your driving privileges. If you do not petition the DMV, your license will be automatically suspended.
