About Georgia DWI/DUI
Georgia law defines the act of drunk driving as driving under the influence. The offense can also be referred to as driving while intoxicated or DWI.
Impairment can be charged based on physical evidence, like having a blood alcohol content at or above 0.08%. This is called a ‘per se’ DWI. Note that a law enforcement officer can initiate an arrest without a BAC test or even when a driver’s BAC is below 0.08%. All that is legally required is the suspicion that you are driving a vehicle in a less safe manner when charging a simple ‘DWI’.
Impairment can be from alcohol, prescription drugs or illegal drugs. A ‘DWI Drugs’ arrest applies to those impaired by drugs, including marijuana, metabolites or controlled substances.
Other DWI related charges include ‘DWI Child Endangerment’ where a minor under the age of 14 years of age is in the vehicle at the time of arrest and ‘Commercial License DWI’ where there the threshold for intoxication is lowered to a BAC of 0.04%.
Loss of Driver’s License
Immediately following an arrest for drunk driving in Georgia, two cases will be filed against you. One is the criminal case that is resolved in the courts. The second is a civil case brought by the Department of Driver Services seeking to suspend your driver’s license.
You have the right to request an administrative review hearing with the DDS and challenge the suspension process. You have, however, only 10 days from the date of your arrest to submit the correct paper work and the required fee. If you do not do so, your license will be automatically suspended with no right to appeal.
While separate from the criminal DWI case, the license hearing is still complicated and involves testimony and presentation of evidence. Having legal representation will not only improve the chances of saving your license, it will give Monroe County DWI Attorney Ann Parman an opportunity to determine the strengths and weaknesses of the state’s case when it comes to the criminal charges.

Penalties for DWI in Georgia
The penalties associated with a GA DWI are based on the type of DWI you are charged with and your blood alcohol content at the time of arrest. An offense will usually result in fines, jail, loss of driver’s license and community service. Depending on details of the arrest, you may also be subject to mandatory enrollment in an abuse risk reduction program, a clinical evaluation and monitored probation.
The severity of the penalties increases with two or more arrests for driving while intoxicated in Monroe County within a 10 year period. Besides longer jail sentences and steeper fines, you risk revocation of driver’s license, announcement of your arrest in the local newspaper, the necessity of installing an ignition interlock device in your vehicle and ultimately the seizure of your license plates.
Because of the long-term impact of a DWI, you should fight the charges. Do not risk your future though with an attorney who will plead you guilty or accept a prosecutor’s first offer. Monroe County Georgia DWI Attorney Ann Parman will work hard to get your case dismissed or the consequences of the DWI minimized.
