Suspension of Your License
An arrest for DWI in Las Vegas will result in two cases being filed against you. One is a criminal DWI charge, which is resolved in the courts. The second is a civil case filed by the Nevada Department of Motor Vehicles to suspend your driver's license.
The standard term of license suspension is 90 days for a first time Nevada DWI offense. It should be noted that even if your criminal case is reduced to a traffic ticket or dismissed, your license would not be automatically reinstated. After the suspension period you will be required to maintain expensive SR-22 insurance for three years and pay license reinstatement fees.
You have the right to petition the DMV and attempt to retain your driving privileges, however you must do so within 10 days of the date of your arrest. The DMV hearing is structured much like a courtroom, with the police and prosecutor presenting evidence it has about your arrest.
You have a better chance of keeping your license with legal representation, and DWI attorney Sean Sullivan has experience with all phases of a drunk driving defense, including scheduling and preparing for a DMV hearing. Consider the impact of not being able to drive to work, school, the doctor or the grocery store. Every effort to try and save your license is crucial and you only have a limited amount of time to act. Contact Sean Sullivan for immediate help.
