West Virginia Drunk Driving Penalties

The severity of your DWI charge in the state of West Virginia is dependent on your blood alcohol content (BAC) at the time of your arrest. First time offenders arrested with a BAC of between 0.08% – 0.15% are charged with a “normal” DWI. Penalties for a normal DWI conviction include up to 6 months in prison, a fine of between $100 – $500, and the possibility of a 6 month license suspension. The length of the suspension can be reduced with the completion of DWI classes and by enrolling in West Virginia’s ignition interlock program.

A first time offender arrested with a BAC of 0.15% or higher is typically charged with an “aggravated” DWI. Conviction for an aggravated DWI offense can typically result in the accused being placed in jail for a minimum of 48 days and up to 6 months. They may also receive a fine of between $200-$1,000 and a 45 day license suspension. Furthermore, participation in the ignition interlock program is mandatory for 9 months following the end of the license suspension.
