West Virginia Drunk Driving Penalties
Any penalties you may be facing as a result of a DWI charge in West Virginia depend on your blood alcohol content (BAC) at the time of your arrest. If you are a first time offender who has a BAC of between 0.08% – 0.15% at the time of your arrest, you will be charged with a “normal” DWI. A conviction will have you facing up to 6 months in prison and a fine of between $100-$500. Your license may also be suspended for up to 6 months. The length of your license suspension may be reduced with the completion of DUI classes and by enrolling in West Virginia’s ignition interlock program.
If your BAC is 0.15% or higher at the time of your arrest, you are facing an “aggravated” DWI. If you are convicted you can be placed in jail for a minimum of 48 days and for up to 6 months. You may also be facing a fine of between $200-$1,000. Your license will also be suspended for 45 days with mandatory participation in the ignition interlock program to follow for 9 months.
