How a DWI in Texas can affect your life
The consequences of a Texas DWI conviction can be serious. A criminal record may affect your ability to find or keep employment. Your auto insurance rates will certainly go up, if your carrier doesn’t cancel you outright. The criminal punishments for a Texas DWI conviction are as follows:
First Texas DWI Offense:
Texas Criminal Status: Class B Misdemeanor.
Jail: Minimum 72 hours, or 6 days if open container is present.
Texas DWI Fines/Costs: Fine not to exceed $2,000. Other administrative and evaluation fees may be assessed. TX imposes a ‘surcharge’ for a DWI on top of regular fines. The surcharge is $1,000 per year for three years for a first DWI offense and $2,000 if the person’s BAC level was double or more the legal limit (.16).
Texas License Suspension: Yes, 1 year. Attending DWI Education class may avoid this. Occupational license may be granted based on need.
Texas Conditional License: A conditional, or occupational license, may be issued based on “essential need” and usually only when the court orders an offender into alcohol assessment/rehabilitation. Offenders who have been granted occupational licenses within 10 years are ineligible. For definitions of ‘essential need’, see Transportation Code Section 521.241. The fines and punishments become more severe with each offense level and number of prior convictions.
Rockwall DWI lawyer John Cook will protect your freedom and rights!
My approach is simple. I will use my vast experience as a former police officer and prosecutor, knowledge of Texas DWI laws and proven trial skills to aggressively represent you. My creative approach often is the difference between a drunk driving conviction and a dismissal, reduction in the charge, or being found Not Guilty on the drunk driving charge. I have achieved these results for my clients even when:
- There was an accident involving drunk driving;
- My DWI clients have failed all field sobriety tests;
- DWI breath test results were over the legal limit;
- DWI blood test results were over the legal limit.
The results obtained depend on the facts of each case, but as a Rockwall DWI lawyer I do not want you to have a conviction on your permanent record. My goal is to successfully fight for your rights and try to make a difference in your case. Hopefully I will earn your confidence so that you would, without hesitation, refer me to others in need of DWI defense. The only way I can do that is to win your case.

DWI dismissed, charges dropped I was arrested for a DWI by very unprofessional cops. John tore apart the prosecution and had my breathalyzer evidence dropped due to coercion. John's skill and an incompetent prosecution led to my charges getting dropped. He's a personable lawyer who actually listens and fights injustice. - KAB
John Cook did a phenomenal job on my case I was stopped for a DUI in Nov 2012. While I felt I was innocent and passed the Field Sobriety Test, the police officer arrested me anyway and I was forced to take a blood sample which came out much higher than the Legal limit. John was actually recommended to me by a friend and former District Attorney so I felt I was in good hands. John did an excellent job of reviewing the evidence, addressing the unique situations and fighting for my Legal rights. Through a very clear presentation and thorough examination and cross examination of the arresting officer, it became very clear that I was not necessarily in the wrong and my rights had been violated.I will certainly recommend John to others based on his knowledge, legal insight, and savvy demeanor in a courtroom.
Direct and Attention to Details John did an excellent job defending me on a dwi case that involved blood evidence. Though he was ready to go to trial to defend me he was able to persuade a judge known to be difficult to allow a motion to suppress hearing separate from trial. This allowed us two opportunities to have this evidence removed from the case. In the hearing he destroyed the states witnesses by identifying many failures in the procedures that they followed. His attention to specific details in the arrest records allowed him to, in my opinion, make the witnesses look like bumbling idiots. Apparently the state thought the same and they quickly dropped all the charges against me. I would recommend him to anyone going through this nightmare.

I HAVE AN EXECUTIVE POSITION WITH A LARGE FIRM IN DOWN TOWN FORT WORTH AND I NEEDED TO FIND THE BEST LAWYER IN TOWN TO RESOLVE MY ISSUE SO MY EMPLOYER WOULDN'T FIND OUT ABOUT MY CASE. I RESEARCHED SEVERAL LAWYERS IN THE DFW AREA AND MET WITH 2 IN FORT WORTH BUT I WASN'T SATISFIED WITH THEIR PROFESSIONALISM AND APPEARANCE. I PLAY A LOT OF GOLF AT SHADY OAKS COUNTRY CLUB AND STARTED TO ASK SOME OF THE MEMBERS I KNEW ABOUT RECOMMENDING A DUI LAWYER. THREE PEOPLE RECOMMENDED JOHN COOK TO ME EVEN THOUGH JOHN WAS LOCATED ALL THE WAY IN DALLAS. THEY TOLD ME JOHN WAS THE BEST AROUND. ANYWAYS, JOHN GOT MY DUI DISMISSED AND MY LICENSE REINSTATED ! JOHN COOK IS A REGULAR GUY AND A VERY GENUINE PERSON. I'M GLAD I DID ALL THE RESEARCH AND FOUND HIM !
The best attorney in DFW area! Mr. Cook handled everything very professionally and in an efficient manner. If I was ever in doubt about anything he would reassure me that everything would be fine. He has been in the business for many years and not just as an attorney, so he knows the different angles to handle a case. He is very easy going and really cares about his clients. I was not charged with DWI the two times I got arrested for them. I have sent anybody I know that gets arrested to him and I have never heard any complaints. Great attorney I would strongly recommend to anybody.

Best Lawyer I have ever dealt with John Cook has represented me in times when I truly needed an attorney that knew what to do and how to perform. I can honestly say that his professional conduct, knowledge, and specific expertise, served me very well! He has a great sense of humor (helps to ease the stress a person may be going through), but is also a master of details and dealing with the court, the system, and opposing sides.John has represented me 3 times, the first being in 2005. Although he was a man of few words prior to that first trial; when it did finally start, John was a true "junkyard dog", and went on an attack I have never experienced. He fought for 3 days and ultimately prevailed!When people ask me for a recommendation for an attorney, that handles DWI or criminal cases, John Cook is the first and only name I give. I really believe that when I engage John, I have already won.
